Roe's Future


Although the American people are opposed to the extreme position of Roe vs. Wade and Doe vs. Bolton, the two U.S. Supreme Court decisions legalizing abortion through all nine months of pregnancy, additional justices on the U.S. Supreme Court are needed to reverse those decisions.

After the death of Chief Justice William Rehnquist, there are only two justices, Antonin Scalia and Clarence Thomas who have expressed opposition to Roe. It is also important to realize that when Roe and Doe are overturned, the issue of abortion will be decided on a state-by-state basis.

During his two campaigns for President, George W. Bush continually promised that if given the opportunity he would appoint justices to the Supreme Court who would strictly interpret the Constitution and not legislate from the bench. He fulfilled that promise by nominating John G. Roberts Jr. to the U.S. Supreme Court. Judge Roberts was confirmed by the U.S. Senate on September 29.

President Bush has nominated Harriet Miers to replace retiring Justice Sandra Day O’Connor. It is the hope and prayer of prolife people that Ms. Miers will be true to the Constitution and not legislate from the bench.

Questions have swirled regarding Ms. Miers position on abortion. One can only be certain of Ms. Miers’ legal position on life issues after she has been confirmed and rules on an abortion-related case as a justice on the high court.
